We\u2019re committed to keeping that trust. That starts with helping you understand our privacy practices.<\/span><\/p>\n<p>This notice describes the personal data we collect, how it\u2019s used and shared, and your choices regarding this data. We recommend that you read this along with our privacy overview, which highlights key points about our privacy practices.<\/p>\n<p><strong style=\"background-color: transparent;\">2.Definitions<\/strong><\/p>\n<p><span style=\"background-color: transparent;\">\u201cWe\u201d or \u201cus\u201d refers to Yesmeal and its subsidiaries and affiliates;<\/span><\/p>\n<p>&#8220;Our&#8221; refers to Yesmeal\u2019s services anywhere in United States, including users of Yesmeal\u2019s apps, websites, features, or other services.<\/p>\n<p>\u201cYou\u201d refers to the users of Yesmeal and its subsidiaries and affiliates;&nbsp;<\/p>\n<p>\u201cAffiliates\u201d refers to affiliated service platforms of Yesmeal, including Yesmeal Merchant Tools, Yesmeal Merchant Services, Yesmeal Delivery Service.<\/p>\n<p>&#8220;APIs&#8221; refers to Yesmeal Application Program Interface which is a way for two or more Yesmeal&#8217;s services to communicate with each other.<\/p>\n<p><b>3.<\/b><span style=\"background-color: transparent;\"><b>Overview<\/b><\/span><\/p>\n<p><span style=\"background-color: transparent;\">A. Scope<\/span><\/p>\n<p>This notice applies to users of Yesmeal\u2019s apps, websites, and other services anywhere in United States.<\/p>\n<p>This notice describes how Yesmeal and its affiliates collect and use data. This notice specifically applies to:<\/p>\n<p>Delivery recipients: individuals who request or receive food, or other products and services<br>Delivery persons: individuals who provide delivery or other services<br>This notice also governs Yesmeal\u2019s other collections of personal data in connection with Yesmeal\u2019s services. For example, we may collect the contact information of individuals who use accounts owned by Yesmeal for Business customers or of owners or employees of Yesmeal partners. We may also collect the personal data of those who start but do not complete applications to be delivery persons, those who rent bicycles, scooters, or other light electrical devices offered by other companies through a Yesmeal app, or in connection with our mapping technology and features.<\/p>\n<p>All those subject to this notice are referred to as \u201cusers\u201d in this notice.<\/p>\n<p>In addition, please note the following:<\/p>\n<p>For California users: Information regarding Yesmeal\u2019s privacy practices related to the California Consumer Privacy Act (CCPA) is available <a href=\"https:\/\/oag.ca.gov\/privacy\/ccpa\">\u6b64\u8655<\/a>.<\/p>\n<p>For Guest Users: The personal data of those who order or receive trips or deliveries via partner websites or apps (such as when ordering from a grocery store), or arranged by other account owners (collectively \u201cGuest Users\u201d) may be used for purposes described in this notice, and may be associated with, and accessible by, the owner of that account. This specifically includes Guest Users who receive deliveries ordered by owners of Yesmeal Health, Yesmeal Central or Yesmeal for Business accounts, or who receive deliveries ordered by friends, family members or others. To submit questions, comments or complaints regarding Guest User data, or to submit requests regarding such data, please visit here.<br>Our data practices are subject to applicable laws in the places in which we operate. This means that we engage in the practices described in this notice in a particular country or region only if permitted under the laws of those places. Please contact us here or through the addresses below with any questions regarding our practices in a particular country or region.<br><strong>4. Data collections and uses<\/strong><br>A. The data we collect<br>Yesmeal collects:<\/p>\n<p>Data provided by users to Yesmeal, such as during account creation<br>Data created during use of our services, such as location, app usage, and device data<br>Data from other sources, such as Yesmeal partners and third parties that use APIs<br>The following data is collected by or on behalf of Yesmeal:<\/p>\n<p>1- Data provided by users. This includes:<\/p>\n<p>User profile: We collect data when users create or update their Yesmeal accounts. This may include their name, email, phone number, login name and password, address, profile picture, payment or banking information (including related payment verification information), driver\u2019s license and other government identification documents (which may indicate document numbers as well as birth date, gender, and photo). This also includes vehicle or insurance information of delivery persons, emergency contact information, user settings, and evidence of health or fitness to provide services using Yesmeal apps.<br>This also includes gender and\/or occupation (when required for certain Yesmeal services or programs, such as Yesmeal Cash Back or Product Recommendation).<br>We may use the photos submitted by users to verify their identities, such as through facial recognition technologies. For more information, please see the section titled \u201cHow we use personal data.\u201d<br>Background check and identity verification: We collect background check and identity verification information for delivery persons. This may include information such as delivery person history or criminal record (where permitted by law), and right to work. This information may be collected by an authorized vendor on Yesmeal\u2019s behalf. We also collect identity verification from Yesmeal users who request alcohol delivery.<br>Demographic data: We may collect demographic data about users, including through user surveys. In some countries, we may also receive demographic data about users from third parties.<br>User content: We collect the information users submit when they contact Yesmeal customer support, provide ratings or compliments for other users or partners, or otherwise contact Yesmeal. This may include feedback, photographs or other recordings collected by users.<\/p>\n<p>2- Data created during use of our services. This includes:<\/p>\n<p>Location data (delivery person): Yesmeal collects this data when the Yesmeal app is running in the foreground (app open and on-screen) or background (app open but not on-screen) of their mobile device.<br>Location data (delivery recipients). We collect precise or approximate location data from delivery recipients\u2019 mobile devices if they enable us to do so. Yesmeal collects this data from the time a delivery is requested until it is finished, and any time the app is running in the foreground of their mobile device. We use this data to enhance your use of our apps, including to enable safety features, and prevent and detect fraud.<br>Transaction information: We collect transaction information related to the use of our services, including the type of services requested or provided, order details, delivery information, date and time the service was provided, amount charged, distance traveled, and payment method. Additionally, if someone uses your promotion code, we may associate your name with that person.<br>Usage data: We collect data about how users interact with our services. This includes data such as access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and third-party sites or services used before interacting with our services. In some cases, we collect this data through cookies, pixels, tags, and similar tracking technologies that create and maintain unique identifiers. To learn more about these technologies, please see our Cookie Notice.<br>Device data: We may collect data about the devices used to access our services, including the hardware models, device IP address, operating systems and versions, software, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion data, and mobile network data.<br>Communications data: We enable users to communicate with each other and Yesmeal through Yesmeal\u2019s mobile apps and websites. For example, we enable delivery persons and delivery recipients, to call, text, or send other files to each other (generally without disclosing their telephone numbers to each other). To provide this service, Yesmeal receives some data regarding the calls, texts, or other communications, including the date and time of the communications and the content of the communications. Yesmeal may also use this data for customer support services (including to resolve disputes between users), for safety and security purposes, to improve our products and services, and for analytics.<br>Audio recordings: In certain jurisdictions, and where permitted by law, users can record the audio of their trips through an in-app feature. Recordings are encrypted and stored on users\u2019 devices, and are only shared with Yesmeal if submitted to customer support by the users in connection with safety incidents.<\/p>\n<p>3- Data from other sources. This includes:<\/p>\n<p>User feedback, such as ratings, feedback, or compliments.<br>Users participating in our referral programs. For example, when a user refers another person, we receive the referred person\u2019s personal data from that user.<br>Yesmeal account owners who request services for or on behalf of other users, or who enable such users to request or receive services through their accounts. This includes owners of Yesmeal for Business accounts.<br>Users or others providing information in connection with claims or disputes.<br>Yesmeal business partners through which users create or access their Yesmeal account, such as payment providers, social media services, or apps or websites that use Yesmeal\u2019s APIs or whose APIs Yesmeal uses.<br>Vendors who help us verify users\u2019 identity, background information, and eligibility to work, for regulatory, safety, and security purposes.<br>Insurance, vehicle, or financial services providers for delivery persons.<br>Partner transportation companies (for delivery persons who use our services through an account associated with such a company).<br>Publicly available sources.<br>Marketing service providers.<br>Yesmeal may combine the data collected from these sources with other data in its possession.<\/p>\n<ol>\n<li>How we use personal data<br>Yesmeal collects and uses data to enable reliable and convenient transportation, delivery, and other products and services. We also use the data we collect:<\/li>\n<\/ol>\n<p>To personalize user&#8217;s experience and to allow us to deliver the type of content and product offerings in which you are most interested.<br>To improve our website in order to better serve you.<br>To allow us to better service you in response to your customer service requests.<br>To administer a contest, promotion, survey or other site feature.<br>To quickly process your transactions.<br>To send periodic emails regarding your order or other products and services.<br>For customer support<br>For research and development<br>To enable communications between users<br>In connection with legal proceedings<br>Yesmeal does not sell user personal data with third parties except with users\u2019 consent.<\/p>\n<p>Yesmeal uses the data it collects for purposes including:<\/p>\n<p>1- Providing services and features. Yesmeal uses the data we collect to provide, personalize, maintain, and improve our products and services.<\/p>\n<p>This includes using the data to:<\/p>\n<p>Create and update users\u2019 accounts.<br>Verify delivery persons\u2019 identity, background history, and eligibility to work.<br>Enable transportation, deliveries, and other services.<br>Offer, process, or facilitate payments for our services.<br>Offer, obtain, provide, or facilitate insurance, vehicle, invoicing, or financing solutions in connection with our services.<br>Track and share the progress of deliveries.<br>Enable features that allow users to share information with other people, such as when delivery recipients provide feedback for a delivery person, refer a friend to Yesmeal, split fares, or share ETA and location with their contacts.<br>Enable features to personalize users\u2019 Yesmeal accounts, such as creating bookmarks for favorite places, and to enable quick access to previous destinations. We may, for example, present a Yesmeal user with personalized food recommendations based on their prior orders. Please see the section of this notice titled \u201cChoice and transparency\u201d to learn how to object to this use of personal data.<br>Perform internal operations necessary to provide our services, including to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends.<br>2- Safety and security. We use personal data to help maintain the safety, security, and integrity of our services and users. This includes:<\/p>\n<p>Screening delivery persons before enabling their use of our services and at subsequent intervals, including through reviews of background checks, where permitted by law, to help prevent use of our services by unsafe delivery recipients.<br>Using data from delivery persons\u2019 devices to help identify unsafe driving behavior such as speeding or harsh braking and acceleration, and to inform them of safer driving practices. We also use data from delivery persons\u2019 devices to verify the type of vehicles they used to provide deliveries.<br>In certain regions, using information derived from driver\u2019s license photos, and other photos submitted to Yesmeal, for safety and security purposes. This includes Yesmeal\u2019s Real-Time ID Check feature, which prompts delivery persons to share a selfie before going online to help ensure that the delivery persons using the app matches the Yesmeal account we have on file. This also includes comparing photographs that we have on file against photographs (i) of other users to prevent identity-borrowing, and (ii) from public databases to verify user identity.<br>Using device, location, profile, usage, and other data to prevent, detect, and combat fraud or unsafe activities.<br>Using user ratings and feedback to encourage compliance with our Community Guidelines and as grounds for deactivating delivery persons with low ratings or who otherwise violated such guidelines in certain countries.<br>3- Customer support. Yesmeal uses the information we collect (including recordings of customer support calls with notice to and the consent of the user) to provide customer support, including to:<\/p>\n<p>Direct questions to the appropriate customer support person<br>Investigate and address user concerns<br>Monitor and improve our customer support responses and processes<br>4- Research and development. We may use the data we collect for testing, research, analysis, product development, and machine learning to improve the user experience. This helps us to improve and enhance the safety and security of our services, improve our ability to prevent the use of our services for illegal or improper purposes, develop new features and products, and facilitate insurance and finance solutions in connection with our services.<\/p>\n<p>5- Enabling communications between users. For example, delivery persons may call a delivery recipient with information about their order.<\/p>\n<p>6. Marketing and Advertising <br>Yesmeal uses data to market and advertise our services and those of our partners, excluding data of guest users. We employ various data points, including account information, approximate location, device and usage data, preferred language, and trip and order history, to personalize ads and marketing communications based on users&#8217; observed or inferred characteristics and interests.<br>We use this data to:<br>\u2022 Send emails, text messages, push notifications, and in-app messages about Yesmeal&#8217;s products, services, features, offers, promotions, sweepstakes, news, and events.<br>\u2022 Display personalized advertising on third-party apps or websites.<br>\u2022 Show third-party advertising within Yesmeal&#8217;s apps or in connection with our services, identified as &#8220;Sponsored Listings.&#8221;<br>\u2022 Provide ads personalized based on current trip or delivery requests, including recommendations for products available at requested destinations.<br>\u2022 Measure the effectiveness of Yesmeal&#8217;s ads and third-party advertisements.<br>We believe these activities serve Yesmeal&#8217;s legitimate interest in informing users about our services and features, as well as those offered by our partners. For more information on how to manage your preferences for marketing and advertising, refer to the sections titled &#8220;Choice and Transparency&#8221; and &#8220;Marketing and Advertising Choices.&#8221;<\/p>\n<p>7. Non-marketing communications. Yesmeal may use data to send surveys and other communications that are not for the purpose of marketing the services or products of Yesmeal or its partners. We may also send users communications regarding elections, ballots, referenda, and other political processes that relate to our services. For example, Yesmeal has notified users of ballot measures or pending legislation relating to Yesmeal\u2019s services in those users\u2019 areas.<\/p>\n<div>\n<div>\n<div id=\"_com_1\" class=\"msocomtxt\">\n<p><!-- [if !supportAnnotations]--><\/p>\n<\/div>\n<p><!--[endif]--><\/p>\n<\/div>\n<\/div>\n<p>8. Legal Proceedings and Requirements <br>We utilize data to investigate and address claims or disputes related to the use of Yesmeal&#8217;s services, comply with legal requirements, regulations, licenses, agreements, insurance policies, or in response to legal processes, government requests, and law enforcement inquiries.<br>We perform these activities based on our legitimate interest in resolving issues related to our services and in compliance with applicable legal obligations.<\/p>\n<ol>\n<li>Cookies and third-party technologies<br>Yesmeal and its partners use cookies and other identification technologies on our apps, websites, emails, and online ads for purposes described in this notice.<\/li>\n<\/ol>\n<p>Cookies are small text files that are stored on browsers or devices by websites, apps, online media, and advertisements. Yesmeal uses cookies and similar technologies for purposes such as:<\/p>\n<p>Authenticating users<br>Remembering user preferences and settings<br>Determining the popularity of content<br>Delivering and measuring the effectiveness of advertising campaigns<br>Analyzing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with our services<br>We may also allow others to provide audience measurement and analytics services for us, to serve advertisements on our behalf across the Internet, and to track and report on the performance of those advertisements. These entities may use cookies, web beacons, SDKs, and other technologies to identify the devices used by visitors to our websites, as well as when they visit other online sites and services.<\/p>\n<p>Please see our Cookie Notice for more information regarding the use of cookies and other technologies described in this section.<\/p>\n<ol>\n<li>Data sharing and disclosure<br>Some of Yesmeal\u2019s services and features may require us to share certain data with other users, either at their request or with their explicit consent. Additionally, we may share such data with our affiliates, subsidiaries, and partners under specific legal requirements or to address claims or disputes related to the use of our services.<\/li>\n<\/ol>\n<p>Yesmeal may share data:<\/p>\n<p>1- With other users<\/p>\n<p>This includes sharing:<\/p>\n<p>Delivery recipients\u2019 first name, delivery address, and order information with their delivery person. We may also share ratings and feedback, or other information to the extent required by law, with the and delivery person.<br>For delivery persons, we may share data with the delivery recipient(s), including name and photo; vehicle make, model, color, license plate, and vehicle photo; location (before and during trip); average rating provided by users; total number of trips; length of use of the Yesmeal app; contact information (depending upon applicable laws); and delivery person profile, including compliments and other feedback submitted by past users.<\/p>\n<p>We also provide delivery recipients with receipts containing information such as a breakdown of amounts charged, delivery person first name, photo, route map, and such other information required on invoices in the country or region where the delivery person operates.<br>For those who participate in Yesmeal\u2019s referral program, we share certain personal data of referred users, such as trip count, with the user who referred them, to the extent relevant to determining the referral bonus.<br>2- At the user\u2019s request<\/p>\n<p>This includes sharing data with:<\/p>\n<p>Yesmeal business partners. For example, if a user requests a service through a partnership or promotional offering made by a third party, Yesmeal may share certain data with those third parties. This may include, for example, other services, platforms, apps, or websites that integrate with our APIs; vehicle suppliers or services; those with an API or service with which we integrate;&nbsp; or other Yesmeal business partners and their users in connection with promotions, contests, or specialized services.<br>3- With the general public<\/p>\n<p>Questions or comments from users submitted through public forums such as Yesmeal blogs and Yesmeal social media pages may be viewable by the public, including any personal data included in the questions or comments submitted by a user.<\/p>\n<p>4- With the Yesmeal account owner<\/p>\n<p>If a user places an order using an account owned by another party, we may share their order or trip information, including real-time location data, with the owner of that account. This occurs, for example, when:<\/p>\n<p>A delivery person uses an account owned by or associated with a Yesmeal partner<br>A delivery recipient gest an order by a friend or under a Family Profile<\/p>\n<p>5- With Yesmeal subsidiaries and affiliates<\/p>\n<p>We share data with our subsidiaries and affiliates to help us provide our services or conduct data processing on our behalf. For example, Yesmeal processes and stores data in the United States on behalf of its subsidiaries and affiliates.<\/p>\n<p>6- With Yesmeal service providers and business partners<\/p>\n<p>Yesmeal provides data to vendors, consultants, marketing partners, research firms, and other service providers or business partners. These include:<\/p>\n<p>Payment processors and facilitators<br>Background check and identity verification providers (delivery persons and cash delivery recipients only)<br>Cloud storage providers<br>Google, in connection with the use of Google Maps in Yesmeal\u2019s apps (see Google\u2019s privacy policy for information on their collection and use of data)<br>Facebook, in connection with the use of the Facebook Business Tools in Yesmeal\u2019s apps and websites (see Facebook\u2019s privacy policy for information on their collection and use of data)<br>Marketing partners and marketing platform providers, including social media advertising services<br>Data analytics providers<br>Research partners, including those performing surveys or research projects in partnership with Yesmeal or on Yesmeal\u2019s behalf<br>Vendors that assist Yesmeal to enhance the safety and security of its apps<br>Consultants, lawyers, accountants, and other professional service providers<br>Fleet partners<br>Insurance and financing partners<br><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: \u5b8b\u4f53; mso-font-kerning: 0pt; mso-ansi-language: EN-US; mso-fareast-language: ZH-CN; mso-bidi-language: AR-SA;\">third-party vehicle suppliers, including fleet and rental partners<\/span><br><\/p>\n<p>7- For legal reasons or in the event of a dispute<\/p>\n<p>Yesmeal may share users\u2019 personal data if we believe it\u2019s required by applicable law, regulation, operating license or agreement, legal process or governmental request, or where the disclosure is otherwise appropriate due to safety or similar concerns.<\/p>\n<p>This includes sharing personal data with law enforcement officials, public health officials, other government authorities, airports (if required by the airport authorities as a condition of operating on airport property), or other third parties as necessary to enforce our Terms of Service, user agreements, or other policies; to protect Yesmeal\u2019s rights or property or the rights, safety, or property of others; or in the event of a claim or dispute relating to the use of our services. If you use another person\u2019s credit card, we may be required by law to share your personal data, including trip or order information, with the owner of that credit card.<\/p>\n<p>This also includes sharing personal data with others in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.<\/p>\n<p>8- With consent<\/p>\n<p>Yesmeal may share a user\u2019s personal data other than as described in this notice if we notify the user and they consent to the sharing.<\/p>\n<ol>\n<li>Data retention and deletion<br>Yesmeal retains user data for as long as necessary for the purposes described above.<\/li>\n<\/ol>\n<p>Users may request deletion of their accounts at any time. Yesmeal may retain user data after a deletion request due to legal or regulatory requirements or for the reasons stated in this policy.<\/p>\n<p>Yesmeal retains user data for as long as necessary for the purposes described above. This means that we retain different categories of data for different periods of time depending on the category of user to whom the data relates, the type of data, and the purposes for which we collected the data.<\/p>\n<p>Users may request deletion of their account at any time through the Settings &gt; Privacy menus in the Yesmeal app, or through Yesmeal\u2019s website.<\/p>\n<p>Following an account deletion request, Yesmeal deletes the user\u2019s account and data, unless they must be retained due to legal or regulatory requirements, for purposes of safety, security, and fraud prevention, or because of an issue relating to the user\u2019s account such as an outstanding credit or an unresolved claim or dispute. Because we are subject to legal and regulatory requirements relating to delivery persons, this generally means that we retain their account and data for a minimum of 7 years after a deletion request. For delivery recipients, their data is generally deleted within 90 days of a deletion request, except where retention is necessary for the above reasons.<\/p>\n<ol>\n<li>Grounds for processing<br>We only collect and use personal data where we have lawful grounds to do so. These include processing user personal data to provide requested services and features, for purposes of Yesmeal\u2019s legitimate interests or those of other parties, to fulfill our legal obligations, or based on consent.<\/li>\n<\/ol>\n<p>We collect and use personal data only where we have one or more lawful grounds for doing so. Such grounds may vary depending on where our users are located, but generally include processing personal data:<\/p>\n<p>A- To provide requested services and features<\/p>\n<p>In order to provide our services, we must collect and use certain personal data. These notifications are a necessary part of using the Yesmeal app and cannot be disabled. However, users may choose the method by which they receive these notifications through the Settings &gt; Privacy menus in the Yesmeal app.<\/p>\n<p>Notifications: discounts and news<br>Users may enable Yesmeal to send push notifications about discounts and news from Yesmeal. Push notifications may be enabled or disabled through the Settings &gt; Privacy menus in the Yesmeal app.<\/p>\n<p>B- Device permissions<\/p>\n<p>Most mobile device platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without the device owner\u2019s permission, and these platforms have different methods for how that permission can be obtained. iOS devices notify users the first time the Yesmeal app requests permission to access certain types of data and gives users the option to grant or refuse permission. Android devices notify users of the permissions that the Yesmeal app seeks before their first use of the app, and use of the app constitutes a grant of such permission.<\/p>\n<p>C- Ratings look-up<\/p>\n<p>After every order is delivered, delivery recipients and delivery persons are able to rate each other on a scale from 1 to 5. The average of those ratings is associated with a user\u2019s account and is displayed to other users for whom they provide or receive services.<\/p>\n<p>This two-way system holds everyone accountable for their behavior. Accountability helps create a respectful, safe environment for delivery recipients and delivery persons.<\/p>\n<p>Delivery person s can see their average rating after tapping their profile photo in the Driver app.<\/p>\n<p>Delivery persons are also rated by delivery recipients.<\/p>\n<p>D- Marketing opt-outs<\/p>\n<p>Users may opt out of receiving promotional emails from Yesmeal. Users may also opt out of receiving emails and other messages from Yesmeal by following the unsubscribe instructions in those messages. We may still send users who have opted out non-promotional communications, such as receipts for delivery recipients or information about their account.<\/p>\n<p>E- User data requests<\/p>\n<p>Yesmeal provides users with a variety of ways to learn about, control, and submit questions and comments about Yesmeal\u2019s handling of their data.
